1. Scope of Service
HDA (Hack Digital Agency) provides conversion rate optimization (CRO), performance engineering, and digital marketing consulting. Our services are “Forensic” in nature, meaning we analyze existing data to implement technical and creative improvements.
2. The 90-Day Performance Pledge
Our guarantee is a commitment to activity and iteration:
- Eligibility: The pledge applies only to “Full-Stack Optimization” contracts where HDA has full implementation control.
- The Goal: If HDA fails to identify a conversion-winning variation within 90 days, we will continue our optimization protocol at no additional service cost until a validated uplift is achieved.
- Prerequisite: Clients must maintain a minimum ad spend or traffic volume (as specified in the individual Statement of Work) to ensure statistical significance for testing.
3. Intellectual Property (The HDA Method)
All proprietary methodologies, “Forensic Diagnostic” frameworks, and custom JavaScript codes developed by HDA remain the intellectual property of HDA Performance Engineering.
- Clients are granted a perpetual, non-exclusive license to use the specific implementations delivered during the contract.
- Reproduction or resale of HDA’s “Optimization Protocols” is strictly prohibited.
4. Client Responsibilities
To hit our 0.8s Speed Engineering and ROI targets, the client must:
- Provide timely access to Google Analytics (GA4), Search Console, and relevant Marketplace APIs (Amazon, eBay, Walmart).
- Ensure that third-party developers do not override HDA’s “Performance Stacks” during the active testing phase without prior consultation.
5. Payment & Late Fees
- Invoicing: Performance retainers are billed monthly in advance.
- Late Payments: Payments delayed beyond 15 days may result in the suspension of active A/B tests and “Speed Monitoring” protocols.
6. Limitation of Liability
While HDA uses enterprise-grade forensic data, digital marketing is subject to external platform changes (Google Algorithm updates, Meta ad policy shifts). HDA is not liable for revenue fluctuations caused by third-party platform downtime or global marketplace volatility.
7. Mutual Confidentiality (NDA)
HDA handles sensitive revenue data for brands like Tracking The World. We maintain strict confidentiality regarding your PPC spend, conversion data, and customer lists. Conversely, clients agree to keep HDA’s pricing models and forensic workflows confidential.
8. Governing Law
These terms are governed by the laws of the jurisdiction where HDA (Hack Digital Agency) is registered.
